Cessation of unlawful conduct after such prior contact shall not render such court action moot under any circumstances, and such injunctive relief shall lie even if such person has ceased such unlawful conduct after such prior contact.

The secretary of state may bring a civil action to enjoin a violation of this section or the rules adopted under this section.

In this subsection, "prosecuting attorney" has the meaning assigned by Section 41.101, Government Code.
